These Terms & Conditions govern enrolment in and use of Elevate Transformation Academy programs, courses, learning materials, assessments and associated digital services.
By purchasing, enrolling in, accessing or participating in an Elevate Transformation Academy program, you agree to these Terms, subject to any rights that cannot lawfully be excluded.
1. About Elevate Transformation Academy
Elevate Transformation Academy provides professional learning designed to strengthen enterprise transformation capability.
The Academy forms part of the broader Elevate Transformation ecosystem and may include:
- self-paced online courses;
- facilitated learning programs;
- executive education;
- assessments and diagnostics;
- practical exercises;
- transformation tools and templates;
- simulations and case studies;
- digital and AI-enabled learning experiences;
- completion certificates and credentials; and
- other professional development services.
The Academy is operated by AYIRA PTY LTD ACN 137 622 434, trading as Elevate Transformation.
In these Terms, “Elevate Transformation”, “Elevate”, “we”, “us” and “our” refer to that entity.
2. Eligibility and Enrolment
You must provide accurate and current information when enrolling in an Academy program.
You are responsible for ensuring you meet any eligibility or prerequisite requirements specified for a program.
Individual enrolments are intended for the registered participant and may not be transferred unless permitted by Elevate.
Enterprise customers may purchase access for multiple authorised participants under separate commercial or licensing arrangements.
3. Account Security
Where an account is required, you are responsible for maintaining the confidentiality of your login credentials and for activity occurring through your account.
You must not:
- share your login credentials;
- permit another person to use your individual account;
- attempt to access another participant's account; or
- circumvent participant, licence or access restrictions.
Please notify us promptly if you believe your account has been compromised.
4. Course Access
The access period applying to each program will be specified at the time of purchase or in the relevant enterprise agreement.
Access may include:
- videos;
- written learning materials;
- exercises;
- assessments;
- templates;
- workbooks;
- downloadable resources;
- digital tools; and
- other program-specific resources.
Elevate may update course content over time to reflect developments in transformation practice, technology, regulation and our methodologies.
5. Intellectual Property
Elevate Academy contains valuable proprietary intellectual property developed by or licensed to Elevate Transformation.
This may include:
- the Elevate Transformation Framework;
- transformation methodologies;
- models and concepts;
- diagnostic tools;
- assessments;
- templates;
- workbooks;
- simulations;
- case studies;
- diagrams and visual models;
- videos and presentations;
- facilitator materials;
- course structures;
- digital tools; and
- related learning content.
Purchasing or receiving access to an Academy program gives you a limited licence to use relevant materials for the purposes permitted by your enrolment or enterprise licence.
Ownership of the underlying intellectual property remains with Elevate Transformation or the relevant licensor.
No intellectual property rights are transferred to you by your purchase, enrolment, participation or completion of a program.
6. Individual Licence
Unless otherwise stated, an individual enrolment provides you with a personal, limited, non-exclusive, non-transferable and non-sublicensable licence to use Academy materials for your own learning and legitimate professional application.
You may apply concepts learned through the Academy in the normal course of your professional work.
This permission allows you to apply your acquired knowledge and skills but does not grant a right to reproduce, distribute, commercialise or independently deliver Elevate's proprietary materials, frameworks, diagnostics, assessments or training content.
Unless separately authorised in writing, you may not:
- share login credentials;
- provide course materials to another person;
- reproduce or distribute substantial course content;
- upload Academy materials to shared repositories accessible by unauthorised users;
- sell, license or sublicense Academy materials;
- deliver Elevate course content as your own training product;
- create competing training products substantially derived from Elevate proprietary materials;
- reproduce proprietary assessments or diagnostic tools;
- remove ownership or copyright notices; or
- represent yourself as an authorised Elevate trainer, facilitator, adviser, partner or certification provider.Â
7. Enterprise Licences
Enterprise access may be governed by a separate agreement defining matters including:
- participant numbers;
- authorised users;
- access duration;
- permitted internal use;
- intellectual property rights;
- reporting;
- administration;
- confidentiality;
- facilitation rights;
- data handling;
- implementation;
- commercial terms; and
- renewal or termination.
Where an enterprise agreement conflicts with these Terms, the enterprise agreement prevails to the extent of that inconsistency and to the extent permitted by law.
8. Assessments and Completion
Some Academy programs may include assessments, exercises, participation requirements or other completion criteria.
Requirements will be communicated as part of the relevant program.
Successful completion may depend on satisfying specified requirements rather than simply purchasing or accessing the program.
Elevate may reasonably verify completion requirements before issuing a certificate or credential.
9. Certificates, Credentials and Certification
Where applicable, participants who satisfy stated requirements may receive a course completion certificate or digital credential.
A course completion certificate confirms completion of the relevant learning requirements.
Unless expressly stated otherwise, it does not constitute:
- a professional licence;
- regulatory accreditation;
- an academic qualification;
- authority to provide Elevate services;
- authority to teach Elevate materials; or
- professional certification by Elevate.
Elevate may establish separate professional certification or credential pathways. Those pathways may be governed by additional eligibility, assessment, experience, renewal, continuing professional development, conduct and licensing requirements.
10. Fees, Currency and Taxes
Program fees will be displayed at the time of purchase or specified in an applicable proposal, order form or enterprise agreement.
Prices may be expressed in a nominated currency.
Applicable GST, VAT, sales taxes or other taxes may be included in the displayed price or added as required by law and disclosed through the purchasing process.
You are responsible for providing accurate billing information.
11. Refunds, Cancellations and Transfers
Refunds, cancellations, transfers, substitutions and credits are governed by the Elevate Transformation Refund & Cancellation Policy, together with any product-specific terms disclosed before purchase.
That Policy forms part of these Terms.
Nothing in these Terms or the Refund & Cancellation Policy excludes, restricts or modifies a consumer guarantee, statutory cancellation right or other remedy that cannot lawfully be excluded, restricted or modified.
12. Australian Consumers
Where the Australian Consumer Law applies, our products and services come with consumer guarantees and other rights that cannot be excluded.
Elevate's voluntary refund arrangements operate in addition to those statutory rights.
Nothing in these Terms imposes an artificial time limit on a statutory right or remedy available under the Australian Consumer Law.
13. European Union and United Kingdom Consumers
Consumers purchasing Academy products online from the European Union or United Kingdom may have statutory cancellation or withdrawal rights for distance contracts.
Special requirements may apply where you request immediate access to digital content or request that services commence during a statutory cancellation or withdrawal period.
Where required by applicable law and Elevate intends to provide immediate access to digital content before expiry of a statutory withdrawal or cancellation period, Elevate will obtain any express consent and acknowledgement required by law before beginning supply.
Any voluntary refund arrangements offered by Elevate operate in addition to mandatory statutory rights.
Further information is contained in our Refund & Cancellation Policy and will be presented through the applicable purchasing process where required.
14. Professional Application
Academy programs are designed to build professional capability and support better enterprise transformation decision-making.
Transformation outcomes depend on organisational context, leadership decisions, execution capability, market conditions and many other factors.
Elevate does not guarantee a particular organisational, financial, professional or transformation outcome from participation in an Academy program.
Participants remain responsible for determining how Elevate methodologies are applied within their organisations.
15. AI-Enabled Learning and Decision-Support Tools
Academy programs may incorporate AI-enabled learning, diagnostic, analytical or decision-support functionality.
AI-generated outputs may contain errors, omissions, assumptions or incomplete information and require human interpretation.
Participants are responsible for critically reviewing outputs before relying on or acting upon them.
Unless expressly stated otherwise, AI-generated outputs do not constitute legal, financial, accounting, investment or other regulated professional advice.
Do not enter confidential, sensitive, personal or restricted organisational information into AI-enabled tools unless:
- you are authorised to provide it;
- the service is intended to process that type of information; and
- doing so is consistent with your organisation's policies and obligations.
16. Acceptable Use
You must not:
- interfere with the operation or security of Academy systems;
- attempt unauthorised access;
- circumvent access controls;
- copy or systematically extract course content;
- use automated systems to scrape Academy materials;
- share accounts without permission;
- infringe Elevate intellectual property;
- misuse another participant's information; or
- use Academy services unlawfully.
17. Suspension or Termination
Elevate may suspend or terminate access where we reasonably believe:
- these Terms have been materially breached;
- access is being shared without authorisation;
- intellectual property is being materially misused;
- fraudulent or unlawful activity has occurred; or
- continued access creates a material security or legal risk.
Where reasonable in the circumstances, we will seek to notify you and provide an opportunity to address the issue before termination.
Any suspension or termination is subject to applicable consumer law and other statutory rights.
18. Technology Requirements
Participants are responsible for maintaining suitable internet access, hardware, software and other technology necessary to access online programs.
We seek to provide reliable services but cannot guarantee uninterrupted availability of internet services or third-party platforms outside our reasonable control.
19. Third-Party Platforms
Academy services may use third-party technology platforms for functions such as:
- course delivery;
- payment processing;
- digital credentials;
- communications;
- video;
- analytics; and
- other technology services.
Those platforms may operate under their own terms and privacy practices.
20. Privacy
Personal information collected through Academy participation is handled in accordance with the Elevate Transformation Privacy Policy.
For enterprise programs, certain enrolment, participation, assessment or completion information may be provided to the organisation sponsoring or purchasing the program where appropriate, lawful and communicated to participants.
21. Availability and Changes to Programs
Elevate may improve or update Academy content, exercises, technology and learning experiences over time.
Where a material change affects a purchased program, we will seek to ensure participants continue to receive substantially equivalent learning value or another remedy required by applicable law.
22. Limitation of Liability
To the maximum extent permitted by applicable law, Elevate is not liable for indirect, consequential or special loss arising solely from participation in an Academy program or the professional application of course materials.
Nothing in these Terms excludes, restricts or modifies any liability, consumer guarantee, right or remedy that cannot lawfully be excluded, restricted or modified.
23. Changes to These Terms
We may update these Terms from time to time.
The version applicable to a purchase will generally be the version in effect when the purchase was made, unless a later change is required by law, expressly agreed or more favourable to the participant.
24. Governing Law
These Terms are governed by the laws of Victoria, Australia.
If you are a consumer, this choice of law does not deprive you of mandatory consumer protections that apply under the laws of your country of residence.
